The short version

Use this site to learn, not as proof. YACHTWEBSITE does not verify ownership, identity, condition, availability or price; it does not negotiate, take deposits or become part of an agreement. If money, travel or a signature is involved, stop and verify everything with qualified independent professionals.

1. Acceptance

These terms apply when you visit or use yachtwebsite.com. By using the site, you agree to them. If you do not agree, please leave the site.

The version shown above is the current one. These terms may change as the project develops, particularly if user-submitted listings are introduced. A material change will be dated and presented clearly on this page.

These terms are written in English. Any translation is provided for convenience only, and in the event of a conflict the English text prevails.

2. What this site is

YACHTWEBSITE is an independent educational website about yacht types, charter destinations, ownership questions and the checks that often matter before a transaction. It is currently an information project. It is not a yacht brokerage, charter agency, dealer, owner, operator, marketplace, legal representative, financial adviser, escrow service or payment processor.

The site does not represent a yacht owner, seller, lessor, buyer, charterer or listing user. It has no authority to make promises, quote a binding price, accept an offer, reserve a vessel or sign an agreement for anyone. A page, message or form on this site never creates a sale, charter, agency, partnership, fiduciary or advisory relationship.

Editorial descriptions and original drawings are there to explain a category or idea. Drawings are stylised, not to scale, and do not depict a specific yacht unless a page says so explicitly.

3. Listings, specifications and prices

No live prices are intentionally published while the site remains in its educational stage. If a monetary figure appears anywhere because of an old page, cached copy, user submission, feed or simple error, treat it as an illustration only. It is not a quote, valuation, asking price, charter rate or promise of availability. A real price may be higher or lower and may exclude tax, fuel, provisioning, delivery, insurance, commission, berthing or other charges.

If user listings are introduced, they will be supplied by the person posting them, not verified by YACHTWEBSITE. We do not promise that a listing user is who they say they are; that they own or may lawfully offer the yacht; or that the description, images, specifications, location, condition, title, tax status, availability or documents are accurate, current or complete.

A user who posts a listing must have authority to do so and must keep it honest, current and lawful. They must disclose material facts and must not use copied images, invented specifications, fake availability or a misleading price. We may review, edit, label, suspend or remove content, but moderation does not amount to verification or endorsement.

4. Transactions and agreements

Every conversation, negotiation and agreement is between the people involved in it. YACHTWEBSITE is not a party to a sale, purchase, charter, lease, option, deposit, delivery, inspection, management arrangement or any other transaction that may follow from contact made through the site.

We do not set or guarantee terms, collect or protect funds, hold a yacht, inspect a yacht, arrange delivery, enforce an agreement or resolve a dispute. Responsibility for identity, authority, negotiations, paperwork, payment, tax, insurance, cancellation, performance, handover and any disagreement stays with the parties and their chosen professional advisers.

Never transfer money merely because a listing, email, identity document or bank detail looks convincing. Confirm payment instructions using a separate trusted channel and use a properly regulated escrow or client account chosen after independent checks. A bank-detail change should always be treated as a fraud warning until verified.

5. Checks you must make

Before spending money, travelling to inspect a yacht or signing anything, carry out your own due diligence. The right checks depend on the transaction, but normally include:

  • the identity and authority of every person involved;
  • legal ownership, registration, title, mortgages, liens and any right to sell or charter;
  • the original documents, service history, class and flag records, tax or VAT status;
  • an independent condition survey, machinery inspection and sea trial where appropriate;
  • the actual location, availability, insurance and operating or charter licences;
  • sanctions, import, export and local-law requirements;
  • a written agreement reviewed by a qualified lawyer in the relevant jurisdiction; and
  • secure, independently verified payment and escrow arrangements.

Do not rely on a badge, ranking, review, email domain, photograph or copy of a document as a substitute for those checks. If something cannot be verified, walk away.

6. No professional advice

Nothing on the site is legal, tax, financial, investment, insurance, technical, navigational, safety or survey advice. General explanations can age quickly and rules vary by flag, location, nationality, use and transaction structure. Ask an appropriately qualified independent professional to advise on your actual circumstances.

7. Acceptable use

You may use this website for lawful purposes only, and you agree not to:

  • use it in any way that breaches applicable law or regulation, or that is fraudulent or has any fraudulent purpose or effect;
  • submit through any form on this site material that is false, misleading, defamatory, obscene, threatening, or that infringes the rights of any person;
  • attempt to gain unauthorised access to the site, the server on which it is stored, or any server, computer or database connected to it;
  • introduce any virus, trojan, worm, logic bomb or other material that is malicious or technologically harmful;
  • attack the site by means of a denial-of-service attack or a distributed denial-of-service attack;
  • use any automated system — including robots, spiders, scrapers or offline readers — to access, copy or index the site or to extract its content in bulk, except for a search engine operating in accordance with our published robots directives;
  • frame, mirror or otherwise present any part of this site as your own, or use our content to train a machine-learning model without our prior written consent.

We will report any breach of these provisions to the relevant law enforcement authorities and will co-operate with them, including by disclosing your identity where we are lawfully required or permitted to do so.

8. Content and intellectual property

All intellectual property rights in this website and in its content — including the YACHTWEBSITE name, the mark and logotype, the written text, the naval architecture drawings, the colour system, the interface design and the underlying code — are owned by or licensed to us and are protected by copyright, design right and trade mark law.

You may view, download for caching purposes only, and print pages from this site for your own personal, non-commercial use. You must not modify any copy, use any illustration or drawing separately from the accompanying text, or use any part of the site for a commercial purpose without a licence from us. Our status as authors must always be acknowledged where content is quoted.

All rights not expressly granted are reserved. If you believe material on this site infringes your rights, write to info@yachtwebsite.com with sufficient detail to identify the material and your claim, and we will investigate promptly.

Where this site links to a third-party website, the link is provided for information only. We have no control over the content of those sites, we do not endorse them, and we accept no responsibility for any loss arising from your use of them. Their terms and privacy policies, not ours, apply once you leave this site.

You may link to our home page provided you do so in a way that is fair and legal, does not damage our reputation or take advantage of it, and does not suggest any form of association or endorsement that does not exist. We reserve the right to withdraw linking permission without notice.

10. Availability

We do not guarantee that this site, or any content on it, will always be available or uninterrupted. Access is permitted on a temporary basis and we may suspend, withdraw, discontinue or change all or any part of it without notice. We are not liable to you if for any reason the site is unavailable at any time or for any period.

You are responsible for configuring your own information technology and platform in order to access this site, and for using your own virus protection software.

11. Responsibility and liability

We are responsible for the parts of the site we actually control and for responsibilities that the law does not allow us to avoid. Nothing here excludes responsibility for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other responsibility that cannot lawfully be excluded. Your mandatory consumer rights remain intact.

What we cannot take responsibility for is a claim, promise, mistake, omission or act by a listing user, seller, owner, charterer, broker, agent, professional adviser, payment provider or other third party. We are also not responsible for a transaction or dispute to which the site is not a party, including loss connected with a false listing, inaccurate specification, changed price, unavailable yacht, failed inspection, deposit, payment, cancellation, delivery, injury, damage or breach of an agreement between users.

Educational material is provided as-is. We do not promise that it is complete, current, error-free or suitable for your purpose. Where the law allows, YACHTWEBSITE will not be liable for indirect or consequential loss, lost profit, lost opportunity or a decision made without the independent checks set out above.

A user who posts unlawful, misleading or unauthorised content remains responsible for that content and for reasonably foreseeable claims arising from it.

12. General

If any provision of these terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force. Our failure to enforce any right is not a waiver of it. These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between us in relation to your use of this site. If a provision cannot be enforced, the rest remain in effect.

The governing-law and operator-identity clauses must be completed after the project’s final operating jurisdiction is confirmed. Until then, no wording on this page should be read as taking away mandatory rights or access to a court that applicable law gives you.

Before commercial launch

This draft is intentionally clear rather than theatrical. It still needs review by a qualified lawyer once the operating jurisdiction, listing workflow, moderation process and payment boundaries are final. A disclaimer cannot make an unfair term enforceable or remove a responsibility that law says must remain.
